If you live in the UK and someone in India needs to act for you, for example to sell or let property, deal with a bank or handle family matters, you give them a power of attorney. One made in the UK has to be signed in the right way and then authenticated before offices in India will accept it.
We prepare the power of attorney from your instructions, or from a draft your representative or lawyer in India has sent, set out the people, property and powers clearly, and take you through signing and authentication step by step.
- Prepared from your instructions or your lawyer's draft
- Apostille or High Commission attestation, as India asks
- Signing arranged with witnesses
- Clear instructions for your representative in India
Who it’s for: Indian citizens, OCI cardholders and others in the UK with property or affairs in India
It depends on your circumstances
When you start, we go through these with you.
Either sign before a UK notary and then get an apostille from the UK Foreign Office (FCDO), or sign before a Consular Officer of the High Commission of India, by appointment at a VFS centre.
Apostille or attestationYour representative should ask the Sub-Registrar, bank or other office which route they accept, and whether they use their own format, before you sign.
Ask firstA power of attorney signed outside India is not printed on Indian stamp paper. It is usually presented in India for stamp duty within three months of arriving there, by your representative.
Within 3 monthsA power of attorney to sell property is normally registered at the Sub-Registrar's office where the property is, by your representative in person.
RegistrationA power of attorney can be revoked. If it was registered in India, the revocation is usually registered at the same office.

Indian power of attorney — quick answers
Should I use an apostille or High Commission attestation?
It depends on the office in India that will receive it. Many accept an apostille, and some ask for High Commission attestation. Your representative should ask them first, and we prepare the document for that route.
Do I need Indian stamp paper?
No. A power of attorney signed in the UK is not printed on Indian stamp paper. The stamp duty is paid in India after it arrives, usually within three months.
Do I need to visit the High Commission?
Only for the attestation route, where you sign before the Consular Officer in person at a VFS centre by appointment. For the apostille route you sign before a notary instead.
Can my representative use it straight away?
Once it reaches India, your representative usually has it stamped and, for a property sale, registered before it can be used.
